By using Fingertips (also referred to as the “Site”, a term that encompasses Fingertips’ content, functionality and services), you agree to abide and be bound by these Terms of Service (the "TOS") and any revised Terms of Service the Site may compile at a later date. Any new service available on the Site or any modification of an existing service is governed by the TOS, which may be modified or updated from time to time. We strongly encourage you to regularly review the TOS. If you disagree with any of the following TOS, you should not use Fingertips.
Fingertips provides its users ("You"), with a fully-modifiable Site enabling you to select and aggregate Third-Party Content from a selection of external RSS feeds and determine your pages and categories.
Page
A page is defined as a separate part of the newspaper, containing categories of information. Pages can be added or deleted, within a framework of options as decided by Fingertips.
Category
A category is defined as an individual box of information on each page, to which RSS feeds are supplied providing content and data. You can add, remove and reposition these categories, within a framework of options as decided by Fingertips. Fingertips does not provide content but rather operates as an enhanced web browser, allowing you to link to chosen stories.
Publisher
A publisher is defined as a website that delivers RSS feeds that we have deemed suitable for inclusion on the site. Feeds have been allocated to the categories considered most appropriate at the Site’s discretion. This allocation is not modifiable by You. The amount of feeds for each category depends on the publishers added by Fingertips to the possible options. Whilst the options of publishers vary from category to category, you can decide which publishers from these options provide the information for each category. You are allowed a maximum of 5 publishers for a category. Fingertips does not undertake responsibility to always provide as many as 5 publishers per category. However, in most cases, far more than 5 options are presented.
Registration of account - Email & Password
You do not need to set up an account (also referred to as “register/registration/sign up”) nor provide any personal information to access and use the Site. However, if you wish to establish, modify and access your personalised Fingertips pages (“Your Content”) from any computer you will need to open an account by providing a valid email address and a password of your choice. Your email address must remain valid as long as your Fingertips account remains active and it is your responsibility to update it should it no longer be accurate or current. More generally, all personal information communicated to Fingertips must always be promptly updated as soon as it stops being complete, accurate or current.
Your password is confidential and you shall not communicate it to any third-party individual or website. You should immediately contact Fingertips should you have reason to believe that your password is being used by an unauthorised person or that said person may be communicating through your account. You shall be liable for all actions taken with your password as well as for any loss or liability consequential to such use. We may cancel your account without notice in the case of any violation of the TOS.
Each time you access the Site by using your email address and password (“signing in”), the latest version of your personalised Fingertips newspaper will be displayed provided that you have saved changes, as directed by the site, the previous time you accessed the Site.
Privacy Policy
Fingertips respects your privacy and that of others. Please refer to the Privacy Policy. Your email address and password are necessary to make your personalised Fingertips pages available from any computer and/or to ensure your site preferences and modifications.
Generally, your privacy policy shall always be compliant with that of Fingertips and you should refer to the Privacy Policy for full details. Additionally, Fingertips has no control over the personal data provided to you by its other users and hereby disclaims all warranties of any kind.
Termination of account
You may terminate your account at any time. In the case of any violation of the TOS, we reserve the right to limit your access to the Site and/or to terminate your account. You understand and accept that we may not be held liable for either of said actions.
Your Content
Fingertips is preset with a default setting throughout the site. Decisions have been made in terms of pages, categories and publishers based on research carried out by Fingertips. We do not take any responsibility for the content of the RSS feeds preselected. We also do not take any responsibility for decisions you make after becoming a registered user with regards pages, categories and publishers. You are free to choose from the options presented to you and are free to share any and only stories, via the News Buddy system, that are displayed on the Fingertips site through RSS feeds we have approved.
You may customise and save your Fingertips newspaper only by setting up and using your email address and password and then by adding or deleting content and moving and editing both pages and categories. Fingertips takes no responsibility for how you choose to do this.
You are solely responsible for your choices of information displayed in your newspaper, regardless of whether that includes Third-Party Content, and share all information at your own discretion.
News Buddy System
The Site also enables you to share stories and communicate with your friends (the “News Buddy system” or “News Buddies”). You must be accepted by other users to be a news buddy, unless you accept them. By inviting another user to become a News Buddy, you have given consent to become their News Buddy, should your request be accepted.
You may create your personal network of News Buddies, view their profiles and access feeds that may not have also been selected by you, but have been delivered to your Site through the News Buddy system.
You also acknowledge that the activity of sharing stories through the News Buddy system may give rise to various types of legal liabilities and you represent that Your Content (whether you are the recipient or sender of the relevant content) complies at all times with the TOS and all applicable laws. You understand that Fingertips does not exercise any control over (other than technical if necessary) and does not pre-screen Your Content or that of your News Buddies and may not be held liable for the communication of any said content.
The use of this service is free of charge, although Fingertips does not undertake that future additional features to the site will also be free.
Distribution of Your Content by Fingertips
You grant Fingertips the right to, directly and indirectly, distribute choices of page, category or publisher for both commercial and non-commercial uses without being liable to any payment of any kind by Fingertips to you. You agree that Fingertips may share this through any of its commercial partners. Fingertips shall, at its sole discretion, decide whether and how it will distribute this information, select its commercial partners and determine all the terms and conditions of said distribution. If you disagree with any of the above, you should not use Fingertips.
Publishing Policy
Fingertips is not the owner of any of the articles or images to which the Site provides links and any of the content published on its pages. Fingertips is a news search engine and aggregator. It facilitates access to the content and information of the referenced news sites. As with any other search engine or aggregator, the articles are accessible by direct link, and the user must go to the publishers’ sites to read them. Fingertips offers publishers the right to add, modify or delete all or part of their referenced web pages and we reserve the right to make the desired changes without prior notice to the user.
No RSS feeds or websites can be added to the list of optional publishers unless approved by Fingertips. Your suggestions and requests for additional publishers can be submitted through the publisher section of the Settings area of the Site.
Third-Party Content
Fingertips has no control over and does not host Third-Party Content. We provide links to Third Party
Content "as is", according to their RSS feeds, to facilitate your web browsing. As such, you acknowledge that we may not be held liable with respect to third-party resources, content, advertisements, products, services or any information and you undertake to directly and exclusively contact the appropriate third party with any claim, grievance or request you may have.
Important Information & General Conduct
To access and use the Site, you must be legally capable of entering into a binding agreement and acknowledge that some Third-Party Content might be found offensive by some and might not be suitable for individuals under the age of 18. You must also abide by all applicable laws and regulations in the United Kingdom and, if applicable, in other countries.
As a condition for accessing and using the Site, you agree:
- Not to post, share or transmit any content that is unlawful, obscene, harmful, threatening, defamatory or hateful or that invades the privacy of any third party;
- To respect the privacy of others, including that of your News Buddies, and the confidentiality of the information you may receive and not to post, share or transmit any unsolicited or unauthorised advertising, promotional materials, junk mail, spam, pyramid schemes, or any other form of solicitation;
- Not to harass, intimidate or in any way threaten any other user of the Site or to impersonate another user by any means including by using her/his email address and password;
- To always provide truthful and actual personal information and to update said information as necessary so that it remains complete, accurate and current;
- To respect the rights of others and, more generally, all applicable laws and regulations relevant to your use of the Site, and not to make available any content that you do not have the lawful right to transmit (including any content that would violate any confidentiality obligations you might have), that would contravene the intellectual or proprietary rights of any third party (including, but not limited to, copyrights, trademarks, service marks or patent rights), or that would violate the right of privacy of any persons;
- Not to engage in any conduct or to post, share or transmit any content that would destroy, harm, limit or interfere in any way with the Site or enable you to gain unauthorised access to the Site, including by using viruses, dangerous computer code, programs or files;
- Not to reproduce, copy, sell, or commercially use, in whole or in part, the Site.
In the case of ANY VIOLATION of the above, Fingertips reserves the right to cancel your account and/or to block you from accessing the Site as well as to disclose any information as necessary to satisfy any request by law or regulations or on request of our commercial partners, at its sole discretion. Fingertips also reserves the right to block any stories through the News Buddy system through the Site should it see fit.
You understand that you may not request any payment from Fingertips for sharing or receiving information through the News Buddy system or through any choices made with regards page, category or publisher.
Feedback & Notice
Fingertips may collect users’ feedbacks pertaining to page, category or publisher options or other matters to do with the Site. You are not entitled to any payment of any kind by Fingertips to you if the Site does this. As a result of this feedback, the Site may also, without any prior warning, block access to certain content, without any liability whatsoever.
We may send you notices via your designated email or display on the Site information pertaining to the site. However, we will not be held liable if any modifications are made without said notice.
Limitation of Liability & Disclaimers
The Site is made available to you "as is." Fingertips makes no warranty, whether implicit or explicit, as to the Site. In particular and without limitation, we may not warrant the continuity and quality available on this Site, or the fact that the Site will always be accessible, or that our users will not violate the TOS or our privacy policy. We may limit or prohibit the use of the Site. We may not be held liable for the failure to make available, or for the deletion of, pages, categories or publishers or information shared through the News Buddy system. We reserve the right to correct possible errors on the Site and to modify, from time to time and without notice, the Site or any part of it. We may not be held liable for any modification, interruption or suspension of the Site or for any resulting damages.
You understand that you are accessing and using the Site at your own risk. Fingertips may not be held liable for your reliance on any information or data you may have accessed or downloaded, directly or indirectly, through the Site. Fingertips may not be held liable for any loss of data or for any damage to your computer system or any other device used through accessing the Site.
Although we try to ensure the confidentiality of your personal information as outlined in our privacy policy, we may not be held liable in the case of a breach of said confidentiality, irrespective of any cause.
You accept that we may not be held liable for any consequential or incidental damages, direct or indirect, caused by use of the Site and that the limitation of liability applies to Fingertips UK Ltd. and to its commercial partners, directors and employees.
Intellectual Property Copyright & Proprietary Rights
Fingertips is an original work protected by intellectual property laws. The structure is protected by copyright and other intellectual property rights. You agree to not modify, sell or distribute this work or to attempt to imitate this work based wholly or partly on the Site or on Third-Party Content. You may access or print information from this Site limited to your personal, private and non-commercial use; any other use is strictly prohibited without receiving Fingertips’ prior written consent. Any contravention of this will result in your liability and furthermore could result in criminal action being taken against you. The registered Fingertips trademark and logo and all other Fingertips trademarks and imagery are owned by Fingertips. You agree not to use or communicate said trademarks, logo or imagery without receiving Fingertips’ prior written consent.
Fingertips is the sole holder of all proprietary rights to the Site including the users’ databases. Any reproduction, publication, transmission or any unauthorised use of the Site may result in your liability and could result in criminal action being taken against you. You undertake not to access the Site by any means other than those made available to you by Fingertips.
All rights not expressly granted to you by the TOS are reserved.
Entire Agreement
The TOS and the Privacy Policy constitute the entire agreement between You and Fingertips and supersedes any prior agreement. You must agree to both in order to register an account. By confirming you have read and agree to these said conditions, you are legally bound to have accepted them.
Choice of Law
The TOS and your relationship with Fingertips are governed by English law. English courts will have jurisdiction over any dispute arising out of or connected with the use of the Site.
